Thank you for choosing to visit The Vales online shop.

All purchases directly support the charitable activities of Global Grooves which is an ‘exempt’ charity, Community Benefit Society registered society number RS7807.

These terms and conditions of sale are applicable to all orders and sale transactions through The Vale website at www.the-vale.co.uk which is operated and owned by Global Grooves.  By placing an order for products you agree to be bound by and accept these terms and conditions.

These sales terms do not affect your statutory rights which cannot be waived or limited by contract.

Who we are

Global Grooves is an ‘exempt’ charity and Community Benefit Society registered society number RS7807 whose registered office is at The Global Grooves Carnival Centre, The Vale Unit 2, Vale Mill, Micklehurst Road, Mossley, Ashton-under-Lyne, OL5 9JL.

The following terms and conditions will apply between yourself and Global Grooves for the sale and purchase of the items contained in your basket, and their subsequent delivery. These terms and conditions of sale do not affect your statutory rights (under Governing Law and Jurisdiction).

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the online shop service, use of the online shop service, or access to the online shop service or any contact on the website through which the service is provided, without express written permission from the organisation.

Our store is hosted on WooCommerce, and also utilises Events Tickets Plus. They provide us with the online e-commerce platform that allows us to sell our physical products, events tickets and services to you.

Availability of Goods and Prices

All prices indicated for products are in Pounds Sterling and are inclusive of VAT (where applicable) at the current rates and are exclusive of delivery charges (where applicable) and any payment gateway fees that will be clearly described during checkout. The total cost of your order is the price of the products ordered plus VAT and delivery charges (where applicable) and payment gateway charges (where applicable) as set out in the payment section of the Website.

Global Grooves attempts to be as accurate as possible when describing products on the Website and we have made every effort to display as accurately as possible the colours and images of any physical products that appear at the store. For example, we cannot guarantee that your computer monitor’s display of any colour will be accurate and true to the real project, though we make every attempt to provide you with as much accurate information as possible.

Global Grooves aims to ensure that the pricing of products on the Website is correct at all times, however, on rare occasions the Website may not accurately reflect the correct details at the moment at which you place your order. We reserve the right to change prices or to withdraw an item from sale without prior notice.

We aim to deliver any physical product within 5-10 working days in the UK. At present, we are unable to offer overseas delivery. If Global Grooves is unable to deliver the goods that you have ordered, we will inform you by email at the address given on your order form as soon as practically possible once the error is discovered.

Acceptance of Orders

All orders are subject to acceptance and product availability.

We may choose not to accept your order; if an item is out of stock, if we are unable to obtain authorisation for your payment or if we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time.

Payment

All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and Global Grooves will not be liable for any delay or non-delivery.

Our Contract

Acceptance of the order and the completion of the contract between you and Global Grooves will take place when we have dispatched the goods you have ordered, and received payment.

When you have completed your order, you will be sent an email confirming your order. It will state what the products are, the cost (including VAT and P&P where relevant) and delivery and invoice details.

Acceptance of Delivery

Whilst Global Grooves takes every precaution to ensure all deliveries reach you in good condition, we cannot accept responsibility for any damage sustained once a product has arrived at the delivery address.

Goods should be inspected upon delivery and any goods that arrive in an obviously damaged condition should not be accepted.

Returns Policy

Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from the Global Grooves online shop.

If you are not satisfied with a product, please notify us within 14 days of the delivery date by email hello@the-vale.co.uk and we will provide return information. Items will be refunded or exchanged providing that you do not use the item; it is in the same condition as when you first bought it; and, you have taken reasonable care to ensure that any item is returned to us safely and not damaged in transit.

Post and package costs are non-refundable and we cannot take responsibility for returns that do not reach us.

If your product is defective or damaged, please notify us within 14 days of the delivery date by email hello@the-vale.co.uk and we will provide the return information. Items will be refunded or exchanged providing you have given us proof of defect or damage.

For defective or damaged products we will refund your reasonable costs incurred for post and package of the goods.

Terms and conditions of event and course ticket sales and reservations

All prices are subject to availability.

Proof of ID will be required when purchasing or collecting discounted or concessionary tickets.

Reserved tickets must be confirmed and paid for in full 14 days before the event date. Any tickets not paid for by this date will be released for general sale.

Tickets cannot be exchanged or refunded.

If an event is sold out, it may be possible for us to resell returned tickets. In order to do this, your tickets must be returned to us at least 48 hours before the performance or screening. Resales are at the discretion of Global Grooves and unfortunately we can’t always guarantee this option will be available.

Late entry and re-admittance to our events is at the discretion of Global Grooves.

Global Grooves management reserves the right to refuse admission and alter the programme without prior notice.

Risk of COVID-19

Venue: THE VALE (“Venue”)

Venue provider: GLOBAL GROOVES (“Venue Provider”)

Covid–19, often referred to as coronavirus (“Covid-19”), is an infectious disease that can result in serious and potentially fatal illness. There is a risk of the transmission of Covid–19 in any environment where people come together. This risk increases in enclosed spaces and with increased numbers of people. The World Health Organisation has advised that the elderly and those with underlying medical conditions are more vulnerable.

Upon entering the Venue, you assume all risk associated with Covid-19 (unless in any way caused by the negligence of the Venue Provider).

You also agree to:

  • abide by all government guidance aimed at preventing the transmission of the virus (further details of which can be accessed via the following link: https://www.gov.uk/coronavirus); and
  • follow all directions provided by team members and set out on any signage within the Venue.

You must not enter the Venue if you believe that you may have Covid-19. By entering the Venue, you are confirming your agreement to the above terms and the following additional matters:

1) You acknowledge:

1.a) the contagious nature of Covid-19 and that Public Health England and many other public health authorities still recommend practising social distancing and you agree to do so at the Venue [and wear a mask if legally required by government guidelines at the time of the event

1.b) the Venue Provider has put in place preventative measures at the Venue to reduce the spread of Covid-19

1.c) the Venue Provider cannot guarantee that you will not become infected with Covid-19 and you further understand that the risk of becoming exposed to and/or infected by Covid-19 may result from the actions, omissions, or negligence of yourself and others around you

1.d) that you have voluntarily attended the Venue at your own risk and that you areincreasing your risk of exposure to Covid-19

1.e) that you must comply with all set procedures to reduce the spread while attending

2) You confirm that:

2.a) you are not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell

2. b) no-one in your household or your support bubble (as defined here and if applicable to you) (“bubble”) (including you) has returned to the UK in the last fourteen days from a country which is on the government’s ‘red list travel ban countries’, details of which can be found here

2.c) no-one in your household or your bubble (including you) has been in contact in the last fourteen days with colleagues, family or friends who have returned from one of those countries or have been in contact with anyone during that period who has been diagnosed with Covid-19

2.d) you do not believe you have been exposed to someone with a suspected and/or confirmed case of Covid-19

2.e) you have not been diagnosed with Covid-19 and are not awaiting the results of a test from a public health authority or private laboratory which might confirm you are infected

2.f) you are following all government guidelines as much as possible and limiting your exposure to Covid-19

2.g) you will not seek to bring a claim against the Venue Provider in the event that you contract Covid-19 unless you have reasonable grounds to believe the Venue Provider was responsible for its contraction through its own negligent act or omission

Failure to comply with the above measures or upon the Venue ascertaining that any of the above statements 2) (a)-(h) are untrue (as applicable) shall entitle the Venue to eject you from the event.

Your Undertakings and Warranties

You warrant that the information given on your order form is complete and accurate. By using the Website, you agree to keep your password and account details confidential, and to take all reasonable measures to prevent unauthorised access to your account. You are responsible for all actions that occur in relation to your account.

Validity

By signing up for an account or ordering a product from the Website you agree to accept and abide by these terms and conditions. The terms and conditions are subject to change at any time. It is your responsibility to check the terms and conditions regularly (particularly before making any purchase) in case there are any changes.

Limitation of Liability

Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction.

Data Protection

Global Grooves will take all reasonable precautions to protect your personal data. We will never make your personal details available to other companies for any purpose. Your submission of personal information through the store is governed by our Privacy Policy below.

3.3 If you specifically agree we may use your personal information to:

(a) send you our email newsletter

(b) deal with enquiries and complaints made by or about you relating to our website;

(c) keep our website secure and prevent fraud;

(d) verify compliance with the terms and conditions governing the use of our website;

(e) Your data may also be available to Google Analytics to enable us and them to carry out analysis and research on demographics, interests and behaviour of our users and supporters to help us gain a better understanding of them to enable us to improve our services.

3.4 If you submit personal information for publication on our website, we will publish and otherwise use that information in accordance with the licence you grant to us.

  1. Retaining and deleting personal data

6.1 This Section sets out our data retention policies and procedures, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

6.2 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

6.3 We will retain your personal data as follows:

(a) Names and email addresses for the purpose of sending out e-newsletters.

(b) Names, email addresses and locations gathered for events will be anonymised and retained for a maximum period of three years for impact evaluation purposes.

(c) Names, email addresses and additional information submitted for the purpose of creative opportunities, tenders or job applications.

(d) For some publicly funded projects we are ask to collect audience ad participants demographics such as age, location, gender, race and details of any protected characteristics data will be anonymised, shared with funders and retained for a maximum period of five years for impact evaluation purposes.

6.4 Notwithstanding the other provisions of this Section 6, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

6.5 Requests to delete personal data will be subject to any applicable legal and ethical reporting or document filing or retention obligations imposed on us.

7.1 We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information.

7.2 We will store all the personal information you provide on our, and where applicable our supplier’s, secure (password- and firewall-protected) servers. This may include data storage services provided in the Cloud.

7.3 You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.

9.3 You may instruct us at any time not to process your personal information for marketing purposes (our newsletter and other email communications.)

9.4 In practice, you will usually either expressly agree in advance to our use of your personal information for marketing purposes, or we will provide you with an opportunity to opt out of the use of your personal information for marketing purposes.

9.5 Please let us know if the personal information that we hold about you needs to be corrected or updated.
